Membership Terms And Conditions

DEFINITIONS. In this Agreement, "the Gym Owner" means Feed The Beast LLC also doing business as Feed The Beast. "I" means the person whose name and signature appear on this Agreement. "Licensor" means the brand owner.

CANCELLATION. If I wish to cancel this Agreement, I may do so by emailing written notice to the gym. The notice must say that I do not wish to be bound by the membership agreement. All sales are final and no refunds will be issued. The membership will be become deleted once request has been reviewed. E mail support@feedthebeastgym.com

MEMBER OBLIGATIONS. This Agreement is a legally binding obligation for which I am financially responsible. If I have a prepaid membership, I acknowledge that the fee paid is not refundable. If I have a month to
month membership, my membership will automatically renew after the month ends and I will continue to be billed according to my regular billing schedule unless I provide notice of cancellation. I agree to be respectful of all guests and members. I agree to wear proper gym attire.
Athletic footwear and appropriate clothing must be worn at all times.Feed The Beast strives to provide a safe and comfortable environment for all members. As such, inappropriate clothing that may present health or safety hazards or damage club equipment, is not allowed. For example,Open-toed shoes or sandals pose a safety hazard for members working out. Jeans or pants with prominent grommets may damage equipment and clothing/tattoos with hateful, lewd or offensive messaging undermines our welcoming environment. Water bottles/jugs of all sizes (including gallon sizes) are allowed, as long as they have a screw-on top. Press-on tops such as those found on certain gallon jugs are not allowed, as these present a spill hazard. All personal belongings must be kept in lockers Bags and any clothing not in use are not allowed on the gym floor. Bags and clothing on the club floor present potential safety hazards and are targets for theft. I agree not to remove clothing in open areas, such as being shirtless in the gym. Changing must be done in the private bathroom spaces. Failure to do so may result in termination of membership. I agree not to conduct any kind of commercial or business activity in the gym and will not act as a personal trainer for anyone within the gym. I understand I am responsible for updating my address, contact and payment information. Failure to do so may result in a late fee. We want every guest to feel welcome. We do not tolerate: Grunting - Excessively loud displays of effort including grunting, yelling, groaning. Dropping weights - Intentionally dropping weights to the ground after the last rep of a set. Showcasing - Flexing, strutting, or making an effort to attract attention. Judging - Mocking, criticizing, or making negative comments related to another person's appearance, experience, ability, knowledge of equipment, etc. After hours is working out before 5:00am and after 9:00pm. During these after hours members must be respectful of creating loud noises inside and outside of the gym and not loiter around the out side of the facility. I will wipe down machines before and after use with provided spray, towels or wipes. Trash will be picked up and put in appropriate bins. Weights will be put back in correct spots after use.

MEMBERSHIP FREEZE. I have the right to freeze my membership for a minimum of one month and up to three months per year, during which time I will not be charged standard membership dues and won't have access to the gym. I must provide written notice at least five days in advance of my next billing cycle. A membership cannot be cancelled during a freeze period.

FACILITIES AND SERVICES. The gym reserves the right at any time to delete, discontinue, repair or replace the facility equipment without any effect on this Agreement. The gym may be closed for up to two weeks each year for maintenance purposes.

PRICES. From time to time, and not more than once per year, the gym Owner may need to increase the price of my membership fees. The gym will give at least 30 days’ notice of any incoming price increase and will make it very clear when the price increase will take effect and how much my membership will cost after the increase. During this period, I will have my usual right to terminate my membership in accordance with the membership terms and conditions. If I do not terminate the membership by the date given to me in the notice, then the price of my membership will be increased in accordance with the notice provided.

MINIMUM AGE. All membership holders of the gym must be a minimum 18 years of age. Feed The Beast does not provide child care services. Minors/children are not allowed to be left unattended while a parent or guardian is working out

NO STEROIDS. I understand that the gym bans the use of steroids and I agree not to use, sell or exchange steroids on the gyms premises.

LIMITATION OF LIABILITY. I agree that, except for any legal responsibility that the gym Owner or Licensor cannot exclude in law (such as for death or personal injury), gym Owner and Licensor are not legally responsible for any: (i) losses that (a) were not foreseeable to me and them when the contract was formed or (b) were not caused by any breach on the part of gym Owner or Licensor; (ii) business losses; or (iii) losses to non-consumers. You agree to indemnify, defend and hold us, our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, and Feed The Beast LLC harmless from any claim or demand, including attorneys’ fees, made by any third party due to or arising out of your breach of this Terms of Use, your use of the gym, or your violation of any law or the rights of a third party.

ACCESS CARD. I understand that only authorized members or guests may access the gym and I am not permitted to share my access cards physical or digital with anyone else. Access cards are not returnable and non-refundable. The access card has been issued to enable me to securely access the gym in accordance with the terms of my membership. If I lose or misplace the card, I need to contact the gym to remove the card immediately. If I require a replacement card, I understand I will be charged for the replacement card at the then-current rate. Day fee guests must be at least 18 years old with a valid driver’s license or photo ID. Individuals under 18 may not purchase a day pass even if accompanied by a parent or legal guardian.

MISCELLANEOUS. This is the whole Agreement between the parties with respect to the Membership Terms and Conditions and supersedes any prior understandings or agreements of the parties whether written or oral, express, or implied. With the exception of pricing changes from time-to-time as noted above, this Agreement may not be amended or modified except in a writing signed by both parties.

PAYMENT AUTHORIZATION. For purposes of this payment authorization, the term "I" refers to the new member whose name appears above as the primary account holder and whose signature appears below. "You" refers to the financial institution where I hold an account. I authorize you to pay membership fees on my behalf to Feed The Beast LLC in the amount of the membership plan I have selected. These payments will continue until I submit a written notice of cancellation of my membership to the gym as instructed in this agreement. I agree I am bound by the membership payment terms and unpaid account balance due upon cancellation. I agree that you will be fully protected in honoring these direct debits and that your treatment of them and rights in respect to them are the same as if personally signed by me. I understand that I must notify the gym of account changes and that I may incur an additional fee whenever there is a payment default. I understand that if I terminate the agreement or stop the automatic membership payment arrangement in a manner not described in the agreement, I may be liable to the gym Owner for damages for breach of contract.

PHYSICAL CONDITION AND NO MEDICAL ADVICE. I confirm that I am in good physical condition and have no medical reason or impairment that would prevent me from my intended use of Feed The Beast facilities. I understand and acknowledge that the gym Owner and Licensor will not and cannot provide me with any medical advice. If I have any health or medical concerns now or after I join, I will discuss them with my doctor before using the facilities. I understand that working out or performing any exercise is strenuous on the body and could possibly cause harm or death. Spotters or safety equipment may need to be used in instances where weight is to to heavy to move. I understand being a part of separate functions such as run clubs or attending special events such as races, obstacle or challenges i am responsible for my own actions which include road and terrain safety. And will not hold Feed The Beast liable for any damages caused to myself, friend, family, spouse, animal or property including mine or someone else's. We strongly encourage staying well seen and hydrated when participating in any event out side of the gym facility.

GUEST REQUIREMENTS. I understand I may be expected to show proper identification when I enter the facility or join an out door function. Also a day pass will have to be purchased for guests to enter the gym.

RULES AND REGULATIONS. I agree to follow any gym rules posted at the gym or communicated by gym sta. Licensor or the gym may, in its sole discretion, modify its rules or policies without notice at any time.

DAMAGED, LOST OR STOLEN PROPERTY. I understand that the gym Owner is not responsible for any of my personal property that is damaged, lost or stolen while in or around the gym location. I understand and agree that I am liable for all damage I cause to the equipment or physical infrastructure of the gym facility inside and out. This includes flushing feminine products, trash or wipes down the toilets as well as clogging the sinks. I will reimburse the gym Owner for ANY damages I cause.

LIABILITY FOR PROPERTY. The gym Owner is not liable to me for any personal property that is damaged, lost or stolen while on or around gym premises including, but not limited to, a vehicle or its contents or any property left in a locker or bathrooms. If I cause ANY damage to the gym, I am liable to the gym Owner for the cost of repair or replacement.

PHOTO/VIDEO NOTICE. I may not take unauthorized photos or videos anywhere in or outside the gym. Posting any photo or video of members with out their consent on social media or to another person will result in termination of membership and may be subject to additional penalties. I understand that the gym uses unmonitored video surveillance and access card usage is logged, which both may be retained by the gym for future use.

Harassment And Inappropriate Behavior Policy

Our goal is to ensure our gym is a welcoming and positive space so everyone can enjoy the benefits of fitness and wellbeing that come as being part of our supportive fitness community.

The safety of all members and team members is paramount to us and everyone has the right to be, and to feel, safe. We expect everyone to be respectful to each other and there are no circumstances where it is okay to intimidate or harass another person.

If any member, visitor, staff or Personal trainer in our Gym feel they have been harassed they should speak to a member of the gym management team, if you are unable to do so please email support@feedthebeastgym.com. Every person and every case will be reviewed in detail then dealt with sensitively and as confidential as possible.

OUR POLICY

This policy applies to all people who use, access, or provide services in the gym.

It outlines what Feed The Beast defines as harassment and our approach to managing allegations or experience of this behavior in our Gym.

HARASSMENT CAN BE DEFINED AS

Aggressive pressure or intimidation.

Unwelcome attention based on personal characteristics.

Conduct which threatens, intimidates, alarms or makes a user uncomfortable putting them at fear for their safety.

Physical violence, or direct or inferred sexual threat.

Threatening, oensive, unwelcome, abusive verbal language or behavior.

HARASSMENT CAN BE

Direct – to you as an individual from another individual or group of individuals.

Indirect – witnessed towards someone else, or a group you are not/ or do not wish to be related or linked to.

Harassment doesn’t have to be about you to affect and impact you.

HARASSMENT EXAMPLES

There are many forms of Harassment, some examples of these are:

Negative, unwelcome, aggressive or detrimental comments about race, heritage or ethnicity.

Comments, jokes or suggestive statements about someone’s sexual orientation, gender or identity.

Derogatory comments or actions regarding a person’s ability or disability – physical or mental.

Exclusive or negative comments, suggestions or behavior towards a person because of their age.

Unkind, negative comments that will offend or embarrass someone because of their size, appearance or fitness levels.

IN FACILITY HARASSMENT EXAMPLES

Harassment may take on many forms, but in a facility environment all of the above can be seen through unwanted, unreasonable and unnecessary behavior that have a negative impact on another person or even group of people.

SEXUAL HARASSMENT EXAMPLES
There are many forms of Sexual Harassment, some examples of this are (this list is not exhaustive):

Unwelcome physical contact – touching, patting, pinching, stroking, kissing, hugging, fondling or inappropriate touching.

Physical violence, including sexual assault (as defined by the Crown Prosecution Service/Sexual Offenses Act).

Sexual comments, jokes or stories that offend or humiliate a person or group of people.

Unwanted comments on a person’s looks, dress, sexuality, age or gender in a derogatory or objectifying way.

Repeated unwanted flirting or flirting at an inappropriate time which could be deemed to undermine or damage a person’s reputation.

Lewd behavior such as leering, whistling or gesturing.
IN FACILITY SEXUAL HARASSMENT EXAMPLES
Harassment may take on many forms, but examples of this in a facility environment are:
Uninvited correction of another member’s form or technique when training.

Taking unsolicited photographs or videos of another person.
Excessive watching or staring at another person – directly or via mirrors.

Continuously exercising next to or near to another person or following them around the facility.

Sending or sharing of unwelcome personal images to any other person. Unwanted flirtation or sexual advances.
Commenting on other people’s body, looks or clothing (appearance).
WHAT TO DO IF YOU HAVE EXPERIENCED HARASSMENT OR INAPPROPRIATE BEHAVIOR

If you feel you have been the victim of harassment by a member or employee, where appropriate you should discuss this with them directly. If this is not possible or you are uncomfortable to do so, you should report it to the Gym Management team immediately or alternatively, you can contact our support office team at support@feedthebeastgym.com We will then commence an investigation which will follow the company procedures and may include:

Report the allegation to an appropriate senior person within the independent franchise operator or report to the email address provided.

Taking a detailed statement from you about the incident.

Discussing allegations with the individual they are against and use eorts to preserve confidentiality.

Reviewing the initial allegations with the Senior Manager to agree any immediate action.

The alleged individual may be suspended from the facility whilst a full investigation is carried out.

A full investigation meeting (via phone or video call) may be arranged with you, with notes of the discussion taken.

Video footage will be reviewed (if available).
Statements/notes will be taken from any witnesses (if available).

A review and recording of any written or other evidence (text, email, social media posts etc) may be conducted.

If, after investigation there is sufficient evidence to support the allegations we will do everything possible to ensure any actions are handled in a timely and just manner, or close proceedings if there is insufficient evidence to support the allegations.

Inform all parties of the outcome.

Oer mediation (if appropriate) to enable and support both parties to move forwards.

If the incident is referred to the Police, we will cooperate in full with all requests.

POSSIBLE OUTCOMES OF EMPLOYEE OR CONTRACTED PT DISCIPLINARY ACTION

If following an investigation of a minor incident, there is a belief that the individual had acted with poor judgement or made an innocent error – coaching and education may be the appropriate course of action to take.

If, however, the investigation provides evidence that there has been direct or indirect intentional harassment, the matter will be reviewed with the owner and a recommended course of action or sanction may be made. Internal processes remain confidential as with all employee management, however, the lessons learned and evidence may be redacted and used in further sta training and education to promote best practice in the future.

POSSIBLE OUTCOMES OF MEMBER INVESTIGATION

If following an investigation of an incident, there is a belief that the user had acted with poor judgement or made an innocent error – a warning, apology and education may be the appropriate action to take.

If, however, the investigation provides evidence that there has been direct or indirect intentional harassment, a formal sanction may be issued. Sanctions will be in line with the following guidance:

A warning of potential ban for a second offense or a severe first offense. Immediate ban of the member.
Referral of the incident, with consent of the aggrieved, to the police.

Internal processes remain confidential, however, the lessons learned and evidence may be redacted and used in further training and education to promote best practice in the future.

SUPPORT TO MEMBERS WHO HAVE EXPERIENCED HARASSMENT

If you are not happy with the process or the outcome, you can request for the case to be escalated to a more senior manager in-line with the organizations procedures to review your case.

We hope you will be comfortable to return to the facility and will support you as much as we can.

If appropriate, you will be oered an opportunity for a mediated conversation with the individual the allegation was against if they are remaining in the facility, if they are agreeable to the session and if you feel this would be beneficial.

If possible, and you would prefer to train at another location, we would support the deletion of membership.

WAIVER OF LIABILITY FOR GYM USE I/We hereby understand and acknowledge that the training, programs and events held by the

Feed The Beast may expose me to many inherent risks, including accidents, injury, illness, or even death. I/We assume all risk of injuries associated with participation including, but not limited to, falls, contact with other participants, the eects of the weather, including high heat and/or humidity, cold and all other such risks being known and appreciated by me.
I/We hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity. I/We acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate

in.
After having read this waiver and knowing these facts, and in consideration of acceptance of my participation and the Feed The Beast furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to
HOLD HARMLESS, WAIVE AND RELEASE the gym, its owners, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in the Feed The Beast training, programs, challenges and/or events.
By my signature I/We indicate that I/We have read and understand this Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.
